Home cottage food producers experience a similar surge as they hit the markets, with many reporting an average yearly income of $30,000. Driven by today’s economy and growing local support, this upward trend shows no signs of slowing down.

Let’s address cottage foods first since they are less regulated than food trucks which I will address in a future newsletter. 

Cottage food production is in a major “boom” phase. If you’re an entrepreneur entering this space, you need to know how to protect your business—and how a Virtual Assistant can help you scale.

What is Cottage Food?

It’s straightforward: food produced in a home kitchen rather than a commercial one. Whether it’s gourmet cookies, artisan breads, or candies, these makers sell directly to consumers via shipping, farmers’ markets, or local pickup.

Is it Legal?

Absolutely. However, having served as a Quality Assurance Superintendent for a frozen food plant for a decade, I’ll admit I initially had raised eyebrows. My job was to “cover our butts” regarding food safety, working closely with the USDA and FDA. So, I dug into the data. Here is what I found:

50-State Legality: Every state has laws pertaining to cottage food, but the rules vary wildly.

The Fine Print: States set their own rules on kitchen conditions, permits, labeling requirements, and annual income caps.

The “Pet” Factor: Some states (like OR and NC) require pet-free kitchens. Others, like my home state of Texas, don’t explicitly forbid it but strongly advise against it.

Evolving Rules: Many states are currently widening their laws, raising income caps, or allowing “perishables” that require strict temperature control documentation.

Professional Standards: Even at home, it is best practice to maintain SOPs (Standard Operating Procedures) and GMPs (Good Manufacturing Practices). If you manufacture a consumable, you need a paper trail.

How a Virtual Assistant Can Help

  • Research Critical Control Points: Set up GMPs and record sheets to track safety checks.
